1. Introduction

These Terms and Conditions ("Terms") govern your use of Market Cross ("the Site", "the Service"), a community forum platform available at marketcross.online and operated by Brindleford Technologies Ltd ("we", "us", "our"), a company registered in England and Wales.

By accessing or using Market Cross, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

To create an account on Market Cross, you must:

• Be at least 13 years old
• Provide a valid email address
• Not have been previously banned from the Service

By registering, you confirm that you meet these requirements.

3. Your account

You are responsible for:

• Keeping your login credentials secure
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorised access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.

You may delete your account at any time through your account settings or by contacting us.

4. User content

4.1 Your content

"User Content" means any text, images, files, or other material you post, upload, or share on Market Cross.

You retain ownership of your User Content. By posting content on Market Cross, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute your content as part of operating the Service. This licence ends when you delete your content or your account, except where your content has been shared or quoted by other users.

4.2 Content standards

All User Content must comply with our Acceptable Use Policy. In summary, you must not post content that is:

• Illegal, threatening, abusive, or harassing
• Defamatory or deliberately misleading
• Infringing on intellectual property rights
• Spam, unsolicited advertising, or pyramid schemes
• Sexually explicit or pornographic
• Designed to harm minors

4.3 Moderation

We reserve the right to remove any content and suspend or ban any user at our discretion, without prior notice, if we believe content or behaviour violates these Terms or is harmful to the community.

Moderation decisions are made by our administrators and volunteer moderators. While we aim to be fair and consistent, moderation decisions are final.

4.4 Content availability

We do not guarantee that User Content will always be available. Content may be lost due to technical failures, moderation actions, or service changes. You are responsible for keeping your own copies of any content that is important to you.

5. Intellectual property

5.1 Our content

The Market Cross name, logo, design, and original content are owned by Brindleford Technologies Ltd. The forum software (NodeBB) is open-source and licensed separately.

5.2 Third-party content

You must not post content that infringes the intellectual property rights of others. If you believe content on Market Cross infringes your copyright, please contact us at legal@marketcross.online with details of the alleged infringement.

6. ActivityPub and federation

Market Cross may connect to other platforms through the ActivityPub protocol (the "Fediverse"). If federation is enabled:

• Your public posts and profile may be visible on other federated platforms
• Users on other platforms may interact with your content
• Content shared via federation is subject to the policies of the receiving platform, which we do not control
• Deleting content on Market Cross will send deletion requests to federated platforms, but we cannot guarantee those platforms will honour them

7. Prohibited conduct

In addition to the Acceptable Use Policy, you must not:

• Attempt to gain unauthorised access to the Service, other accounts, or computer systems
• Use automated means (bots, scrapers) to access the Service without our written permission
• Interfere with or disrupt the Service or servers
• Circumvent any security measures or access restrictions
• Impersonate any person or entity
• Collect personal data of other users without their consent
• Use the Service for any commercial purpose without our prior written agreement

8. Third-party links

Market Cross may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of those websites.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• Any content will be accurate, reliable, or complete
• Defects will be corrected

10. Limitation of liability

To the fullest extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve months preceding the claim (if any)

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

• Your User Content
• Your violation of these Terms

We may modify, suspend, or discontinue any part of Market Cross at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

We may update these Terms from time to time. We will notify registered users of material changes by email or by a notice on the Site. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination:

• Your right to access the Service ceases immediately
• We may delete your account data in accordance with our Privacy Policy
• Provisions that by their nature should survive termination will remain in effect (including intellectual property, limitation of liability, and indemnity)
